The Student Room Group

Criminal Law

Consider the liability of Jaime and Catelyn for murder only in both situations. Questions 1 and 2 carry equal marks:

1.

The Bodbury University Christmas Ball is approaching. Jaime asks Dani if she would be his date to the Ball. Dani refuses Jaime as she has already agreed to go with Bran. The following evening Jaime is in the Students’ Union. He goes to the toilet, situated on the second floor at the top of a flight of stairs. Just as Jaime leaves the toilet, Bran reaches the top of the stairs. Jaime, angry with Bran, shoulder barges him as he walks past him. Bran loses his balance, causing him to fall down the flight of stairs. As a result of the fall, Bran suffers convulsions, causing him to bang his head on the floor. Consequently, Bran dies.

1.

Catelyn, having had an argument with Tyrion, pushes him from the top floor of the Bodbury Shopping Mall. Tyrion is seriously injured by the fall. His injuries include a fractured pelvis, broken legs and severe internal bleeding. He is taken to hospital by ambulance. However, due to an outbreak of dysentery, Bodbury General Hospital is closed. Consequently, the ambulance is re-routed to Adderton Hospital, a further 40 miles away. As a result of the delay, Tyrion suffers significant blood loss due to his internal and external injuries, which means that, by the time he arrives at the hospital, the only way his life can be saved is if he consents to a blood transfusion. He refuses this and, as a result, he dies. Any advice??
