I am researching a moot problem around theft. One of the points is that the defendant left behind the property before leaving the shop. I swear that I have seen a case where two men went into I think it was a Tesco store, drunk, and intended to steal some items. However, before they left one had a change of heart and left the property in the shop and proceeded to run away, after this he was arrested and charged with theft. His conviction was later quashed.
The only problem is that I cannot remember any names in the case or even the year. Anyone who thinks they have heard of this case or has any idea about the names involved I would greatly appreciate it so that I can use the case in my moot.
