If you are told to discuss whether there is duty of care as judge (for tort law), should you incorporate Art 2 of human right act (right of life) and combat immunity principle in your answer?
Because we are specifically told that we are marked based on our discussion of duty of care, would incorporating the other two in the discussion be exceeding the scope?
