What is it you can't get your head around re: murder?
The whole concept, i think its because it'd be better if i broke it down into bits and learnt it, the law on murder is so muddled up it confuses me, and ontop of that my teacher wants me to do wider reading on it but it doesnt make sense.
Could someone please explain what the Gammon Test is?
It is 5 principles to help the courts decide if an offence is strict liability or if it requires mens rea (they usually don't make it clear)
First there is a presumption that it requires mens rea (sweet v parsley) Second the presumption can be rebutted by the wording of the statute (Storkwain) Third - the more serious the crime is, the more likely it is that it requires MR (with the exception of s5 Sexual Offences Act) Fourth it must be an issue of social concern (Blake) Last it must help to promote law enforcement (Alphacell)
I got 187 UMS and when you guys say you aren't revising everything, do you just mean for section A? or are you completely leaving some topics? I am revising everything but they are my only exams so no excuses What did you get last year? and everyone else?
what topics are you guys going to be revising? I'm going to do omissions, homicide, defences and theft (unlikely to come up but could for section C)
Well I am just revising everything.. I think that is what the teacher expects us to do as well :L law exams are the only ones I have so might as well I suppose..
