Not if he consents to it, which he can do retroactively should he want to. It would count as rape in court if the guy didn't agree to it and decided to press charges ( and I know of at least one case where a guilty verdict was reached in such a case, tho that was in Norway I think ).

Recently ive been sleeping with a girl and im very happy with her
