The act doesn't apply to HRMC because it is owned by the Crown.

The Crown owns land and property - everyone's - and data is just property. You pass that property onto corporations, they become the bearer of that property but there is a legal protection of them. The only protection that property can have is to be protected from other bearers except when the Crown passes it on, because the Crown owns that property by default. It is therefore legal for the Crown to pass on any property and sell it, if it so wishes. That's in theory anyway.
