Privacy laws and communal gardens

Does anyone know how privacy laws apply to communal gardens? You see my uncle has a ground floor flat which opens out via French doors onto a communal garden, and the upstairs neighbour is able to see into his living area, is this in breach of the privacy laws even though the garden is 'communal'?

I'd expect not. I had a ground floor flat that opened up onto communal gardens.. We bought curtains.

Iam experiencing the same thing I live in converted 3 bedroom house that is now flats upstairs and downstairs are one bedroom flats and my bedroom window and kitchen window is where so called communal garden can be shared between upstairs and me which I think is wrong the garden is tiny and the only place to sit is right outside my bedroom window which when was a house was s parlour room I don’t understand how there can be allowed communal access when generally upstairs flats don’t have access to gardens and my council housing are treating these flats as if the blocks of flats when it’ was a 3 bedroom semi detached house
