degree-level law Economic Loss Essay Question Watch

    Hello everyone,
    I have an essay question on Economic Loss that I'm finding difficult to answer.
    I need to consider how policy determines whether Economic Loss should be a recoverable in a negligence action.
    Can anyone help?

    You need to consider all the cases surrounding whether pure economic loss should be recoverable. The question links to Spartan Steel v Martin. Also, look at Hedley Byrne v Heller, Caparo v Dickman, Anns v Merton, Murphy v Brentwood etc.

    The question is basically asking you to consider the 'floodgate' argument since the use of policy prevents an indeterminate amount of claims from an indeterminate amount of claimants with regards to economic loss.
