Eric goes to visit his elderly aunt, Celia, who has lived on her own since her husband died ten years ago. As Eric has no money and no job, he takes food from Celia without paying her for it. As Celia values her independence, she does not allow Eric to help out with housework, but he does cook the occasional meal for them both. Celia also feels sorry for Eric, so pays him to look after her garden.

One day, Celia falls over and is unable to reach the telephone. Eric tries to help Celia to her feet and offers to go for help, but Celia refuses his help, insisting she will be fine in a moment. Feeling offended, Eric goes out for a long walk. Some hours later, Celia dies due to lack of medical attention.

    Please answer the following question.

Using case law to support your arguments:

Discuss whether Eric could be held criminally liable for his omission to act.

You can only be held criminally liable for omission if a duty of care was owed.
