If Scotland does not become independent, the status quo remains.

The Scottish government can choose whether to impose fees on people resident in Scotland, in England, in Wales and in Northern Ireland. Scotland cannot impose fees greater than whichever of those groups gets the best deal (at present Scottish residents who have nil fees) on non-UK citizens of the EU. Scotland can choose to impose fees on non-EU overseas students.

Whether the nil fee policy for Scots will remain will depend on Scottish politics. Of the parties in the Scottish Parliament, only the SNP backs the policy at present. Furthermore it isn't clear to what extent the policy is Salmond's "baby".

If the referendum is lost, there will be a move within the SNP to get rid of Salmond. The SNP will have to re-invent itself as a party to govern Scotland within the UK and it may think that it will be easier to do that without Salmond. A new leader may, or may not, have a different opinion on the policy.
