On what basis could the person filming be prosecuted? He didn't exactly do anything, he didn't assault. He just videod something that was happening. He didn't even post it online or anything from what's been said. And she isn't a minor, so child porn doesn't apply.

This was the precise point I was going to make. Initially I wouldn't have said it was necessary but considering the amount of guys who think this is completely acceptable I think the point does need to be made that actually it is completely unacceptable. Let's be real, this sentence has been made to set an example. I also don't see the relevance of comparing it to random separate incidence which has had shorter sentences because they aren't the norm anyway i.e. most people who go around glassing people don't get off with community service.

And to the guys who keep parroting 'if a woman did this...' - I think the whole ****ing point is that women don't engage in these kind of activities because they generally don't see it as something acceptable to do 'for a laugh' :rolleyes:.


If people think his behaviour was acceptable we need better education. We don't need to be throwing one student in jail just to 'set an example'. 9 months is certainly disproportionate - Oscar Pisctorious is likely to serve 10.

Ok so let's turn this around.

In my first year of Uni one of the guys in my flat drank himself to sleep when there was a big group of us in the kitchen, one of the girls who was over at the flat was pissed as hell, decided to drop her knickers and sat on the guys face, while one of her mates filmed it.

The guy in question was very upset when he saw the video because he wasn't exactly "one of the lads" and had a long term girlfriend, and yet the reaction from damn near every guy was that he was a bitch for complaining about it. He went and complained to the head of his college (this was at at University with a collegiate system) and was basically laughed out the door.

What do you think would have happened if he had gone to the police? I would bet every penny I have that absolutely bugger all would have been done. She wouldn't have been arrested, wouldn't have been charged with anything and sure as hell wouldn't have been sentenced to nine months in jail.

Why is man on woman viewed as a despicable offence while woman on man is viewed as a bit of a laugh?

Personally I don't think this should be classified as sexual assault. The act wasn't sexual, it was a prank. It's the difference between accidentally brushing someones butt and deliberately touching them there. It's the sexual intent that makes it sexual assault and that clearly was not present in this case.

So you're suggesting that because it involves a penis it must be inherently sexual? If that were the case doctors would all be guilty of assaulting their patients. Granted they have a more sensible reason. But a reason being daft doesn't make it any more sexual.


If a doctor did anything involving your genitalia without your consent then yes it would be viewed by our legal system as sexual assault.

This is clearly very wrong.
And to answer the bolded question, whilst I don't think it's right at all I suspect the reason is that men are usually less fussed about this sort of thing. This thread itself is proof, there are so many guys saying it's just a laugh/he doesn't deserve jail time but very few girls with that opinion.

I agree with that but it's unfair on the lad. This issue warrants a free punch in the nuts, not a life times punishment of a criminal record. Imagine thinking that you were gonna be a solicitor, and then it transpiring that, after 9 months of being beaten the crap out of in prison, you would have no choice but to get a road sweeping job. You wouldn't be able to look your family in the eye. You wouldn't be able to get a girl friend of a similar education to you (imagine being relatively bright, and then having to marry a chavy, tracksuit wearing individual on a council estate).... It's bad beyond words.

I'd genuinely consider suicide if it was me.

Then simple answer. Don't do stuff that would land you in that position. The guy only has himself to blame sorry. This is the problem with our generation. People seem to think the consequences of their actions shouldn't apply to them. I have no sympathy at all for him.

A lot of people who did that at my undergrad uni (Criminology or Criminal Justice) did it because they couldn't get into LLB Law. Then they would have to do a Postgraduate Diploma in Law and then follow that with the Legal Practice Course.

I can't imagine you've led a completely perfect life and never done anything wrong. This guy's punishment is completely out of proportion.

I agree. If this was me I'd rather settle it with a free kick to the balls rather than pressing charges.

9 months in jail seems terribly unfair - what he did is gross, but I think some education and some hard graft cleaning up gum or scrubbing some graffiti would be more useful to the guy than being introduced to prison life.

Weird I can see a few discussing the sentence being disproportionate, but I'm struggling to find posts with guys sharing their amusement over the situation, making jokes about the girl etc, ah well I must have some sort of filter installed.

Anyway honestly nine months isn't ridiculous tbh, btw does he have to serve the entire thing or can he serve less with "good behaviour" or some other BS which cuts sentence time?

But yeah, nine months isn't a lot, those who saying it's more the stain on his record, well he'd have that on his record even if he'd had 8 weeks in jail or a suspended sentence I assume (as in criminal record check would show it). It'll ruin his life? Maybe he shouldn't have slapped a girl with his cock eh? Though I suppose if he was incredibly drunk he may not have much clarity of thought, but obviously that sort of defence didn't work on any appeal so I guess he wasn't wasted.

Will agree though, no way in hell a girl sitting on a guys face while he was asleep would serve a prison sentence. I mean a mate was sexually assaulted by two girls at a nightclub, bouncers didn't want to know (no surprise) and I highly doubt police would have given a crap either.
