Henry, I've decided that I will not be contesting the revocation as a separate issue, and that I will focus entirely on the fact that the £500 offer constitued an offer, and that the revocation was not effective. For this reason, I will not be usin the Brimnes case, unless Katy or Daniel raise it in their arguments, and I've decided to go forward with Byrne v Van Tienhoven and Tayleo v Insurance which was held in the US Supreme Court. Although Tayleo was held in another jurisdiction, the mooting guidelines state that foreign cases can be influential.

Yes it can be influential but not binding. It will in some sense persuade the judge i think. How do you find out the US Supreme Court Judgment?Which law review did you use?

I searched the net for about 2 hours, that's how I found it lol.

Although its not binding, the fact that it was decided in the US Supreme Court, and has set a binding precedent in the US for the last 160 years would be quite influential.

I was going to use the Brimnes case initially, but I thought it was not a strong point, and so I decided to drop it. However, I've put together an argument about the Brimnes case, just in case Katy or Daniel put forward the case to support the initial judgement that the revocation was acceptable in law.

How is your mooting prepartions coming along?
still not much point for the vagueness of the contract,which is my first submission. Where did you find the U Supreme Court judgment?Can you show me the link?Maybe there are some cases which might help me there

Good luck. However, you don't necessarily need two submissions. I will be presenting one, broad submission. Dont stress over this mooting too much. Focus on your essays.

I'm off. I have to do my public law essay. 2,000 words :eek:
Yes I think probably I'll just do one submission. That will be much better and more points for me to talk about rather than just simply splitting them into two and presenting overlapping points.

2nd submission: Bramble's acceptance mirrors the terms of the offer. Hence there is a contract formed. But I tend to get the feeling that it may be outside the ground of appeal

I think it may be a little outside the ground of appeal. Furthermore, my first argument should cover the fact that there was an offer.
It will be very brief though, and I'll be using the Carlill v Carbolic Smoke Ball Co case as well, but using the judgment of a different judge.
