Criminal law problem question criminal liabilityWatch
Geoff is a heroin dealer. Last night, Jane and her sister Kate bought heroin from him at his flat. Geoff prepared a syringe of heroin for each of them. Jane injected herself with the heroin, and then also injected Kate, because Kate’s hands were shaking and she was finding it difficult to inject herself. Jane and Kate then went home to the flat they shared. Shortly afterwards, Kate started having symptoms which Jane recognised as the symptoms of heroin overdose. Jane tried to take care of Kate, but did not telephone for medical help, as she was worried that the police would become involved. During the night, Kate died as a result of the heroin overdose.
Discuss the potential criminal liability of Geoff and Jane for Kate’s death.
