Eligibility question! Help!

So here is the situation. The person in question is an EU national but they have not lived in the EU for the 3 years prior to the start of their course (only the first 2 years and then moved away for a year). UKCISA website states that missing the 3 year criteria you may still classify for EU university fees if:
the relevant family member of a non-UK EU national, and that non-UK EU national is in the UK as a self sufficient person or as a student; or
the relevant family member of a UK national who has exercised a right of residence in another EU member state, for more than three months, as a self-sufficient person, a student or a worker
and
your relevant family member has been ordinarily resident in the EEA and/or Switzerland and/or the overseas territories for the three years before the 'first day of the first academic year of the course' that you are studying.
So I am wondering if it applies to student loans as well? The person in question is married (so "relevant family") to someone (EU national) who has lived in England for almost his entire life. Is the person eligible for a tuition loan? Also, is there any restrictions on how long they must be married for?

Sorry the student wouldn't be eligible for funding.

In order to apply as a family member of a an EU national, the family member must be working in the UK and the student would need to have been living in the EU for 3 years before the start of their course.
