Hi,

I'm having a bit of difficulty with regards to whether these terms are unfair:

9. Matilda’s Home and Garden reserves the right to deviate from the original landscaping plans made with the buyer where those plans become impracticable, including (but not limited to) when the ability to implement as planned is affected by weather conditions or the discovery of inappropriate soil composition for particular plants, etcetera.

10. Matilda’s Home and Garden reserves the exclusive right to determine the practicality of plans as referred to in term 9.

11. Matilda’s Home and Garden shall not be liable for damage to existing vegetation in the landscaping process.

13. The buyer agrees not to claim for damages should Matilda’s Home and Garden fail to complete the work as agreed. In such an instance, Matilda’s Home and Garden will reimburse the buyer for any payments made beyond the value of the work completed.’

Does anyone have any case law/statues to back up their answers?

PLeeeeaseee it would be really helpful, I cannot find anything.
