Yes they can sue.

I had one girl from St Albans try and sue me for accidentally hitting her car at no more than 5mph, and I swear to god. Her sh*tforsaken Fiesta LX R-reg had the most tiniest of bumps.

Being honest, I declared fault, and the next thing I know, she's trying to hire an S-Class Mercedes for 2-weeks! Okay, if that wasn't taking the piss, I then get a letter saying I will have to go to court as my insurance company are contesting a whip lash claim of £1200 caused by myself.

Of course, not that I was to going to pay the fine win or lose, but I thought I'd have to visit the dishonest bitch's house and put her car windows in for real. Job done, never heard from her again :biggrin:

So moral of the story, it will be unlikely to get to court based on limited evidence, and her/his insurance companies refusal to pay for those costs to get there :smile:

i spoke to my insurance company and they say they cant do much about it, they will try to get out of it depending on the cost.
they sent me a letter through their solicitor and said i must forward the letter to my insurance company or some ****!

i cant believe some people to be honest. really selfish.

Civil case then, which is odd. It will get thrown out, your insurance company should be intervening.

Trust me, been there, done that. My insurance company said that she went through the insurers solicitors, to proceed with damages (like ****). The paperwork arrived at my doorstep without my insurers knowledge, to which I informed my insurers. They said they couldn't so much until I told them they can, and also reminded them I know a certain Mr 'Ombudsman'.

Your insurers have a duty (normally as party of fully comprhensive insurance) to insure you not just for your car, but damage to vicitims and public property.

You will not in anyway be liable, I promise you. Even if for one moment you were taken to magistrates court, it would be thrown out in a matter of seconds, as the 'victim' would need some serous evidence to file a claim against just you.

You can suffer from injuries at any speed accident. It's the action that causes the damage, and not just the force.

A friend of mine suffered neck pains for a few weeks after someone bumped into her while they were parking - a doctor confirmed this. She didn't claim though, as it wasn't a big deal. Whether the person is more seriously hurt in this case, or is just 'on the fiddle' I couldn't say.

sniperwookie is correct! Speed at moment of impact is not as important as the way the head moved at that time.

The person doing the claiming has to produce evidence of injury by way of medical reports etc.

There is a nominal rate of compensation for whiplash injury that an insurance company, once satisfied that the injury has been sustained, will offer.

It is up to the injured person whether they accept this first offer or not - in which case the claim can become protracted with the insurers usually arranging for the claimant to be examined by a doctor acting on behalf of the insurance company.

The amount of compensation paid to the injured party does not make any difference to the guilty party regarding the amount of insurance premium in the event of it being raised.
It is the number of claims, not the amount of settlement that determine the following year's premium.

lol - try and prove your neck is crippled from a 5mph smash - its virtually impossible. I've been involved in incidents slightly more than 5mph!

If 'Kristanae' is being honest, and she hit her vehicle at 5mph, the (presuming a lady here) would have to get medical records to prove undeniably her inability to work or carry out duties etc.

The judge presiding will laugh. I recommend playing them at their own game. If someone is genuinely injured, fine, but when people start causing you time through something that is fraudulent or exagerated, then I feel obliged to act upon it. Can't stand dishonest people.

If she's got whiplash, one would imagine she has a neck support / brace on to support her poor neck.

my insurance says theres no way of proving she got whiplash or didnt, she could just have neck pains or something like that.

So ur saying if my insurance company pays out as much a little as 50 pounds for injuries or as much as 1500 pounds, my premium will still go up?

We weer stuck on the m25 in alot of traffic, and i wasnt pressing gas so it couldnt have been at a speed of more than 5mph.

if she is really injured then fair enough, i do feel bad enough as it is and i would pay out of my own pocket to make them better, but if shes trying to just make some money out of it then yeah im not gonna be happy.

I am able to understand that accidents happen, and I'm not going to just grab for money the very second someone slips up.
Peoples attitudes are hilarious nowadays. How will £200 make my neck better? It'll heal by itself over time, simple as that.
Another hilarious example is claiming for "damage to feelings". Hilarious! If someone thinks I'm an ugly bastard, they can feel free to say it.

Basically, if the person was a respectable person at all, they wouldnt be claiming. Theyre trying to get as much money out of you as they possibly can. Do NOT feel "sorry" for them. The only thing you should feel sorry for is the fact that they didnt die horribly in the accident. (Hah, I'm so controversial.)

Thats what i thought, nothing is wrong with her car so i wont hear from her so all is good,
i was extremely apologetic, i gave her my insurance details as well as my phone number in case something was wrong and all i get is a letter in the post from her solicitor, and the letter was quite threatening.

At the end of the day its not up to me if my insurance wanna pay her for whiplash is it?
