    Hi,
    Just need some help with a problem question I've been asked to do.
    The question is whether a delivery organisation would be liable for corporate manslaughter for the death of a member of the public caused by one of their drivers. In the case they didn't preform adequate checks to ensure he had a licence and the van was overloaded.
    Under the new Act the relevant duties of care are the same ones as found under the tort of negligence, so what would be the relevant duty of care of the organisation to the public?

    Any help much appreciated just to make sure I haven't left out the obvious!
