EU free movement of workers, please help!Watch
I've been given a problem question on the free movement of workers. I have used TFEU and relevant directives. I really need some help with regards to structure so i can answer this.
Basically the problem says that EU nationals of an Italian auto firm are coming over to the UK to do mechanical work on a short term contract for the car industry. When they get to the UK the British workers of the company have barricaded the doors. There are protests being held 'British jobs for British people'. The hotel where the workers are staying is barricaded by media and demonstrators. The UK government wants to send the eu migrant workers home.
I have established that they should not be discriminated against under relevant eu law and that they have the right to be in the uk.
But with regards to the contract, can the italian firm sue BOTH the uk car firm since it failed to carry out terms of the contract. AS WELL as the UK government for being in the wrong for sending them back? WHICH court will this go to? Will the italian company recover damages in excess of the short term contract for each worker, or only recover what would have been lost?
Please, i need some help with this, I am tearing my hair out. Any relevant tips on /guidance/case law would be appreciated.
