B834 - Dual Mandates Bill, TSR Government/ TSR Labour
Dual Mandates Bill 2015

An Act to prohibit individuals from holding multiple elected offices


BE IT ENACTED by the Queen's most excellent Majesty,in accordance with the provisions of the Parliament Acts 1911 and 1949, and by the authority of the same, as follows:-


1: Prohibition of Dual Mandates
(1) At any one time, no individual may hold more than one of the following offices:
a. Member of Parliament
b. Member of the European Parliament
c. Member of a devolved institution (MSP, AM or MLA)
(i) Individuals are prohibited from being a member of more than one devolved institution.
d. Directly-elected mayor of a city or council area
e. County, district, borough or unitary authority councillor
(i) Individuals are permitted to be a district or borough councillor whilst consecutively a county councillor elected in a ward in that district or borough.
f. Police and Crime Commissioner

2: Cases of Dual Mandates
(1) Individuals contravening section 1 at the time of commencement of this Act are exempt from its provisions until they next contest an election for any of their offices.
(2) Individuals elected to an office whilst holding another office, which would cause them to contravene section 1, are removed from the office they previously held.
(3) Individuals elected consecutively to multiple offices,which would cause them to contravene section 1, are removed from the lower-ranked office as they are stated in section 1.

3: Commencement, Short Title and Extent
(1) This Act may be cited as the Dual Mandates Act 2015.
(2) This Act shall extend to the United Kingdom; and
(3) Shall come into force immediately.


NB. Although now a Bill from TSR Labour, it was submitted during their time in Government, and so I have posted it tonight, counting it as a Government Bill.

Ummm what?! This is already the case in law... Are we just going to submit real laws now and pass them?

Sensible bill, should be relatively uncontroversial - its an 'unsurprising' Aye from me.

Are you going to change the top bit to 'TSR Government' then?

The top 2 by EU law yes, that hardly makes the bill irrelevant, this just puts the whole dual mandates issue in one simple piece of legislation.

Nope, Peter Law served as both MP and AM for Blaenau Gwent.

Not in Scotland (see Alex Salmond).

Also I'm pretty sure our local AM is a county councillor too.

So why not sum them up (with some extra restrictions - BoJo as Mayor and MP is another) in one bill?

BoJo is resigning but he only had one year left, generally I think if the people want it there isn't much of an issue so long as they can do both jobs & if they can't they will be voted out
