An acceptance has been defined as a final unqualified expression of assent of assent to the terms of an offer.


Discuss the above statement with particular reference to the law in relation to instantaneous methods of communications. Do you consider the law is sufficiently clear in this regards.

This is a very unusual question. I can't seem to see what the nexus is between instantaneous communication and an unqualified expression of assent. Neither can I see what the relation is with the fact that it's final.

It's not because it's instantaneous that an acceptance can be conditional! Could it have to do with revocation and the post office rule (not applicable to instantaneous communication) stating that acceptance is valid upon emission?

I could imagine the question being:

This appears to be more plausible!

I personally think you should focus on the 'final' part because acceptance in instantaneous communication can be revoked/modified (as long as it's communicated before the acceptance) since acceptance is valid upon communication, analyze that against the fact that acceptance under the post office rule is effective on emission. leaving the offeree no possibility to revoke/modify acceptance.
