    Hi,

    Can anyone help me with this problem? I really cannot get into this area and have no idea where to start

    In 2007, Jon, Sarah and Richard brought a property in London (18 Northbay Road) to live in. They contributed unequally to the purchase price; however, the transfer deed transferred the property to all three as beneficial joint tenants.

    In 2009, Jon moved to Leeds. He handed a letter to Sarah and Richard stating that he wanted the house to be sold immediately so he could take his share. The letter was thrown away by Sarah and Richard.

    In 2013, Richard gave a note to Victoria, his girlfriend, saying 'I give you my share in 18 Northbay Road'. The note was not signed. Last manth Richard died following an accident. His will let all his property to Victoria. Victoria and Jon want to sell 18 Northbay Road, but Sarah is opposed to the plan.

    Anyone? I'm having great difficulty with this.

    1. The three co-owners purchased the property by unequally contributing to the price; however, the transfer deed transferred the property to all as three beneficial joint tenants.

    S1(6) Law of Property Act 1926 provides that only the joint tenancy exists at law, but equity does recognise that co-owners may be either joint tenants or tenants in common. Am I correct in thinking that in equity they are joint tenants (the transfer deed)
