You can apply to uni in whichever year takes your fancy. If you do want to apply after you've left school, you might just want to check with a tutor at school how they would handle your reference and whether you'd apply through them or as an independent candidate- I'm sure that unless they reeally hate you or something they'd be quite happy to sort everything out for you.

Of course, there's nothing saying you can't apply for deferred entry this year, see what happens and then if you're not happy, decline and go through the whole thing again the year after. The only thing you can't do is hold a deferred place and THEN apply again- you have to give it up before applying in 09/10

As he/she will be doing A-Level German if they decide to do languges, then it might be conditional.
You can still apply in your upper sixth year if you want to, but for deferred entry. Otherwise apply in your gap year. Depends which you prefer really- applying next year when you've got your school to help you and to get it out of the way, or in your gap year when you won't have anything else to worry about.

If you don't know what you want to do yet, it might be better to wait until you do know before you apply. It shouldn't be too much of a problem applying as an independent applicant, as long as you have a nice tutor to write your reference, but you can probably get a reference when you leave sixth form then copy and paste it into your UCAS form.
