accident with courtesy car

Just enquiring
A family member had an accident with someone who was driving a courtesy car and they decided that there is nothing wrong with their car after the accident and went.
I dont know if they were insured to drive the car or not and havent decided to make a claim.
Today the owner of the car has rang and said there is a small dent and a few scratches on the car so he wants to sort it out through cash or with the insurance company.
Can he claim on my insurance even though the people who were driving dont want to claim and the fact that when they were driving they might not have been insured?

No I wouldnt think so - there's no evidence. The courtesy cars usually come with insurance, like a hire car I think.

Surely if it was agreed at the time there was no damage, no photographs were taken, the owner cant ring up and tell you theres scratches on the car - they could have come from anywhere.

Don't know if I've got the wrong end of the stick here - your post is really quite confusing to read and understand.

Your post isn't very clear. Can you try and explain a bit more what happened? Whose fault was the accident (your family member or the other person)? Who are you saying wasn't insured?

When you have a courtesy car you are still covered on your normal insurance. When you collect a courtesy car you normally have to take your driving licence and insurance documents. So whoever was driving the courtesy car should be insured. Is that what you mean?

The people driving the courtesy car arent insured.
My family member caused the accident.
As there was no damage to the courtesy car they said it was ok.
The owner of the courtesy car just rang up my house and says that there is some damage to the car, which wasnt seen at the accident.
Can he still claim even though the drivers dont.

how can you not be insured on a courtesy car? do you mean they borrowed it off someone who was using a courtesy car?

and no, they can bugger off because they can't prove it was you.

They borrowed the car from someone and werent insured?

Unfortunately when the courtesy car was taken out, the company would have done a check of it, to check any damage, and show you first, so that you knew what was already there. If anything is different when you come back, chances are you will be liable for that damage. It is your responsibilty also when you take the car to ensure you agree with everything thats there and check it over yourself to make sure you dont miss anything

Its pretty irresponsible borrowing a courtesy car from someone anyway and driving it without insurance.

Of course you can say that you wont pay for the damage etc and it wasnt you, however the company are well within their rights to pursue you for costs

In that case then whoever took the courtesy car will be responsible, tough luck really, its their problem!!

I take it your relative had given their details as the other person contacted them? If they report you then theres not much you can do, however I very much doubt they will if they were driving uninsured themselves!!
If i've understood it right (and I doubt I have...)

Courtesy car owner needs to claim the cost for the repairs from the driver of the courtesy car at the time of the accident.
Courtesy car owner needs to claim that money back off your insurance as you hit them.
Your insurer will tell her where to go as they are not insured and there is no proof that you caused the damage, she can continue and fight for the money back and risk being prosecuted for driving without insurance.

I think you almost have it Paul, except that the courtesy car owner let another person drive the car who hit the OPs relatives.

The courtesy car owner would be insured, however the people who borrowed the car were not, hence the problem!

Yep, hence the courtesy car owners will need to reclaim the costs from the driver, not the insured person who borrowed the car. It may even me the courtesy car owner has to claim the money off the person who signed the agreement, then them claim it off the person they lent it to, but since they were uninsured, they are also in trouble...lol.

its so confusing!
As soon as it happened I would have phoned the police - uninsured driver - and got my insurance legal cover to sort out an accident with an uninsured driver. Hindsight is great.
