    Hey guys

    I need help with this scenario

    Bob, a newly appointed fork-lift driver, was engaged in moving large packed heavy tents and other camping related equipment from the depot/warehouse and placing them in the shipping containers parked outside.
    Bob had been working non-stop for over 10hours. He was very tired and sleepy. A large item that Bob was transportinginto the container fell and injured Linda Lloyd, a visitor to DTCEM Ltd.

    Linda was kept in hospital for 5 days. She sufferedsevere injuries to her back, dislocated her right shoulder and fractured her righthand.Her right hand index finger wasamputated. She will not be able to play her piano again.

    Bob was dismissed the same day. Darran, the shift-manager,contacted ‘Any-Work Ltd.’ a local employment agency, for help. The next day‘Any Work Ltd.’ sent Carol as a replacement driver.

    Carol, took over from Bob and attempted to placeall the remaining items into the availablecontainers. Whilst Carol was driving the truck she was involved in an accident anddamaged Ian Knight’s Audi motor-car parked nearby. Ian is the Assistant GeneralManager of DTCEM ltd.

    Ian, in front of the other male drivers, told herthat she was useless. She was a disaster and should not have been sent by ‘AnyWork Ltd.’
    She heard him say that she was “a typical pathetic womandriver who should be at home raising her kids” and not trying to work alongside men.

    when Carol informed John, the assistant personnel manager, about whatIan had said, John shrugged his shoulders and showed her an email from RogerTurner, one of the company directors which stated that: “as there is so muchunemployment in area, any future jobs should first be given to young Englishmen …….”

    Carol went to see Steven, the National Fork LiftDrivers Union [NFLDU] representative and asked for help.
    Steven booked an urgentmeeting to see Ian Richards, the chief personnel officer. During the course ofthe meeting, Ian told him that NFLDU was becoming a real headache, anundesirable expense for the company, and that in future he was not be allowedany time-off for trade union duties.

    If you know the issues here you can pretty much find most of the answers on ACAS. Some of it is contained in legislation but it shouldn't be too hard to find, again if you know what the issues are in this scenario.

    I'm sorry, i'm not here to do the question for you.
    Reply to this comment with what you think the issues are (what part of employment law is considered for each issue) and then i'll point you in the right direction.

    in the first scenario, we have to look at the:
    - judicial tests
    -health and safety
    -Working time regulation 1998
    -Did bob consent to working for more than 10hours
    -Occupiers liability 1957
    -Negligence-Compensation
