    Access to Internships Bill 2016

    A Bill to regulate the offer of internships

    BE IT ENACTED by The Queen's most Excellent Majesty, by and with the advice and consent of the Commons in this present Parliament assembled, in accordance with the provisions of the Parliament Acts 1911 and 1949, and by the authority of the same, as follows:-

    1. Definitions
    The following definitions are used in this Act:
    1. An 'internship' is an arrangement whereunder an individual (the 'intern', who is not employed in the same product market in which the provider operates, spends time with the provider, performing tasks as dictated by the provider, for the purpose of gaining experience in the provider's industry.
    2. The purpose of any arrangement will be assessed independently of any contractual or other documentary specification.
    3. An 'internship provider' is to be interpreted functionally as an undertaking, rather than being based on the doctrine of legal personality, including but not limited to the following rules:
      a) Members of the same corporate group are to be interpreted as a single internship provider;
      b) Where positions at a similar level within the organisation are generally filled by volunteers other than those on internships, the organisation is not to be interpreted as an internship provider; and
      c) Where agreements or tacit collusion exists within an industry for the purpose of avoiding the rules set out by this Act, all parties to the agreements and/or colluders are to be regarded, for the purposes of this Act, as a single internship provider.
    2. Applicability of minimum wage
    1. An internship provider shall henceforth be required to pay interns at least the minimum wage, provided the following conditions are met:
      a) The intern is 18 years old or more;
      b) The internship provider, or the functional group of which they form a part, has annual turnover of at least £1,000,000 (one million pounds);
      c) The internship is not required for completion of a higher education course by a body independent from the internship provider; and
      c) The internship is expected to last for one week or more.
      i) Where an internship is not originally expected to last for one week or more, but the cumulative time period the intern has spent in an internship with the internship provider exceeds this threshold, all sums which would have been paid had the internship originally been expected to last for one week or more become due.
      ii) The time spent, or expected to be spent, in an internship is the net time over their lifetime that the intern spends, or is expected to spend in an internship with that internship provider.
    2. Failure to comply with this requirement will be regarded in the same way as failure to pay an employee minimum wage.
    3. This requirement does not apply to existing internships which have been going on continuously for two months or less at the date of commencement of this Act.
    3. Non-discriminatory internship recruitment
    1. An internship provider must require that candidates do not provide information as to their identity, or contacts within the internship provider, on, or related to, any application.
    2. The internship may choose, where this is not complied with by a candidate, whether to discard the application, or whether to have it edited before it is seen by the decision-maker.
    3. If it is edited, this may be done either internally or externally to the internship provider, or sent back to the candidate for amendment.
    4. Failure to ensure that the decision-maker is unaware of the information listed in subsection 1 above will be punishable by a fine not exceeding £10,000 (ten thousand pounds) per candidate.
    4. Commencement, Short Title and Extent
    1. This Act may be referred to as the Access to Internships Act 2016;
    2. This Act will extend to the United Kingdom; and;
    3. This Act shall come into force on the first of January 2018.

    This Bill seeks to remedy that problem, and also evade the problem of nepotism in the offer of internships.
