I've just been revising this too. I don't get why tribunals are even under the same category as ADR. How are they even related? Aren't tribunals just a kindof resource for the courts to offload some of their cases?


Tribunals are under ADR because its another method of resolving an issue (such as unfair dismissal, you could take your employer to an employment tribunal) rather than taking it to court. Hope that helped :biggrin:

Thank you that did help!! I get it now, I went over my notes like 5 times, I think I was experiencing some kind of brain blockage...overload of information I think. haha

and also, the DIFFERENCE between them is that ADR is where parties are CHOOSING to avoid the court system because of various problems with it, but tribunals are used because that is the only way of resolving certain civil matters, mainly disputes that are to do with rights.

Hmmm don't know him. Do you do it with the school or is it like an outside company that comes in and does it. Our teacher isn't really a teacher, he's more of a lecturer and you can tell he hasn't been trained as a teacher aswell. I think he just expects us to know everything and looks at us really weirdly if we have a question. haha.


school. yeh haha thats like my teacher!!!!!!! ah hes terrible. i havent learnt anything this whole year, i've taught myself the whole syllabus in the past week haha. ill be happy if i come out of there with a C tomorrow. :P

What's likely to come up in LW2 anyone know?


So far i've revised: Judicial Precedent, Statutory Interpretation, Legislation, EU and EC Law, Juries and Bail

Whoops... There's loads more but what usually comes up, I've lost my revision pack :frown:

Basically for everybody else to save searching:

In Factortame the ECJ suspended the Merchant Shipping Act

I believe it was a spanish fishing company who registered in the UK and were, therefore, fishing in UK waters. The Merchant Shipping Act stopped this but the ECJ said that the UK could not do anything as it would be discriminating according to Nationality within the EU

the question could be from any part of the course.

LW3 - 45mins

acts of parliament
delegated legislation
statutory interpretation
european union

answer the compulsary qu on this paper. there is no choice!

Yep tonight will be long.. Staying up till 3 am and then waking up at 8 again for last few hours of revision. So happy that the exams at 1.30 instead of 9 am

Dredz... Whoa, imagine staying up until 3 AM and then missing the exam! Ouch, disaster avoided :smile:

On a more negative note.... Everyone saying tonight will be a long night... i wish it could go on a bit longer! I'll be staying up for most of it too, depends on how long I can last. I still need to go over statutory interpretation, i HATE that arghhh. Gonna leave out delegated legislation and law reform because i absoultely hate them, and if they come up in paper 2 i'll try and do another question. Hey thanks Saki for posting the Factortame case up here, i had to get offline quickly so didn't have much time, am glad people don't have to search it up. You've helped me out a lot, too. :smile:


:frown: Am dreading tomorrow. Seriously all of you guys though, try and be positive (like i can talk), if you're feeling unprepared, remember we still have about 9 hours to go! I'm gonna try and make full use of them... sleep can wait till after the exam.... I'll definately make sure I make up for lost time!

I got a lil' tradition/superstition, before I open the question booklet I say a little prayer :tongue: This time Ill pray for all u lot, and hopefully we'll all open the booklet at the same time :smile:
Aw, thanks Dredz :biggrin:... I pray too, all the way into the exam room, while sitting in the exam room listeninig to teachers tell you to hand in your phone... and while I open the paper. I shall pray for y'all as well... let's all kick some examiner ass together :biggrin:

Nah, wasn't up then, I was fast asleep by 3... Oh dear, the Dreaded Day has really come :frown:

woke up at 6 but have been staring at my notes for ages just panicking away, not taking anything in. Does anyone else have that' my breakfast is gonna come up' feeling?

OK well i probably won't check this forum till after the exam... less than 2 hours to go (is anyone else REALLY paranoid, like me, i leave my house like an hour early before an exam, though college's not that far away.... ). Can you believe, in a couple of hours it'll all be over? Gonna go and do some last-minute cramming; so take care everyone... breathe deeply, pray hard and hopefully, we'll all do our best...
