    As the title suggests, what is the position now regarding cy-près and initial failures? Does s18 of the Charities Act 2006 (or s67 charities act 2011) make it easier for courts to apply cy-près now and disregard case law (Re Harwood and Re Rymer)?

    How should I go about answering a question on whether cy-près should be applied?Do I still use Re Harwood and then go on and state that the law has now changed because of s18 and it may be easier for the courts to find a general charitable intention?
