    VM384 - Motion to Encourage European Commission Investigation Into Apple, TSR Socialist Party

    This House notes:

    1. Under Article 102 of the Treaty on the Functioning of European Union, abuse of a dominant position within the internal market is prohibited.
    2. Following T-201/04 Microsoft Corporation v Commission, technical bundling may be regarded as anticompetitive conduct even if the tied product is free software.
    3. Apple ties many different products to its phones and music players, whether that is free software (in the form of iTunes), or proprietary cables.
    4. While competitors in different markets have been investigated, Apple never has.

    This House believes:

    1. Apple holds a dominant position within the smartphone and portable music player markets.
    2. The technical bundling of these products amounts to anticompetitive conduct, and therefore an abuse of a dominant position under Art 102 TFEU.
    3. Apple should be investigated for abusing its dominant position by the European Commission.

    No, I've made my position quite clear. I don't feel they've done anything wrong, and to investigate this matter would be a waste of time, and costly - two things which we should be pushing to get away from!

    Nay, this works on the assumption that there may be some guilt, but only a very small chance, considering that to be sufficient to launch an investigation that we will be paying for and almost certainly going to come back with the "yeah, we just spent a load of your money to do nothing"
