pls help me with the law question , i dont know what to write watch

    The UK’s leading fracking company, Eternal Lite plc, recently relocated to the north of England. Chief Executive Officer, Dora Meade announced that because of this move the company’s share prices had increased and the company has therefore decided to award an ex gratia payment of £10,000 to each employee for this achievement, payable in July 2015.

    The company’s applications for additional fracking licences were refused in June 2015. Dora decided to cancel the payment of £10,000 each to the company’s 500 employees because she feared the payment would leave a huge financial dent in the company’s accounts. Former trade unionist Sultan Amin is Dora’s husband and head of the company’s IT and security systems. He warned Dora of the consequences of cancelling the payment especially as the company made £2 billion profits in the 2014/2015 tax year alone. Dora insisted that the payment was a mere ex gratia payment and was not intended to be an enforceable promise. But the following Monday during the company’s weekly team meeting, Dora was presented with a signed petition demanding payment of the money promised.

    As the names on the petition were typed in alphabetical order using the employees’ last names, Sultan Amin’s name was first on the list. Dora fumed when she saw this but controlled her anger at work. At home however, she accused Sultan of orchestrating the petition and told Sultan “What you did today was the last straw in a long list of things you have done to undermine our relationship. I am therefore divorcing you.” Dora’s lawyers served Sultan with a divorce petition. Sultan was shocked to read from the petition that Dora would not allow him to get anything from their prenuptial agreement, which stated that if the couple were to divorce Sultan was to receive one-third of Dora’s £5billion fortune. When Sultan asked Dora if she meant this, Dora explained that “the prenuptial agreement was a domestic agreement based on love and affection and was not meant to be considered by the cold courts of our land.”

    Advise Sultan whether he is able to rely on the rules on intention to create legal relations to enforce the prenuptial agreement.

    This looks confusing - is the question at the end part of a series of questions you're going to get, or is this it? The question asks nothing about the issue relating to the shares promise??

    Also the question is asking specifically about intention to create legal relations and nothing else! which is very unrealistic - if this was a 'real life' legal problem that a real life lawyer would be asked to advise on, it would involve so much morre things - like illegality in relation to the fracking - so seems like a bit of a joke all round, tbh.

    Anyways - assuming this really IS the question, it's solely to do with intention to create legal relations then - and the legal status and enforceablility of pre-nuptial agreements in this context (have you covered this on your course, too, in the context of intention in contract law?)

    So, start with the general principle of social/domestic agreements not being binding, Balfour etc etc then the exceptions - and there is a hint here isn't there, that possibly their marriage was based on a business style arrangement? (and the legal status of pre-nuptials? - you need to establish is this is relevant to your answer, cos in real life, it would be - and the current law is Radmacher v Granatino 2010, NOT legally binding, but can be used in evidence in court to show the parties intentions.

    Seems strange you're not being asked about intention in relation to the shares too, though! :0
