    Hello,

    Long story cut short the third party claims that they have a witness when after the incident we both drove off to a garage. Is there any way to prove that they are lying. I am still currently waiting for a reply from the insurance.

    It would be pretty hard to prove somebody was not there, but this is fraud so maybe contact the police to report it? A forensic telecoms expert can show their mobile was not present but the police (as usual) will try to worm their way out of investigating it because they will claim it's a civil matter and not their problem. Look up the definition of fraud to check and then you *could* ask them to do their job and make an official complaint against them if they try this on.
    Any local CCTV? Any other witnesses?

    It was a minor incident do you think the police would actually investigate for that? It was in a McDonalds carpark. How would I go about getting cctv?and no other witnesses

    If it was in mcdonalds carpark then go in and ask them to see the cctv (the sooner the better). We had a minor accident in the carpark at the mcdonalds i work at recently and they used the cctv.

    CCTV records aren't held forever - they may have wiped it. You should contact them asap.
