Do you think its right that employer can ask which university you went to, i mean if its the same degree, why does it matter what uni you went to.

Because the content of courses with the same name can vary greatly between universities-hence why they often ask to see your full transcript to see what you studied, which will give away where you studied.

Also, some unis are just genuinely better than others
Yes its perfectly fine.
It does matter which uni becayse some are harder to get into and more repsected than others.

Some employers do blind testing these days though.

Also some of the top universities ask what school you went to, if you have the same grades why would that matter.
It's not discrimination. What you've described isn't a protected characteristic.
that's not discrimination, it's also perfectly legitimate, degrees in the same subject from different institutions are not equivalent at all - do you think a student with a 2.1 from an ex-poly in psychology is equal to someone with a 2.1 from oxford in psychology? not even close...
