Should I claim on accident with outcome of 50/50?? Watch

Hi, I was involved in a car accident recently. Reported it to my insurer who said the outcome would be 50/50 if I chose to claim unless the other party admits fault-which they wouldn't.

So decided not to claim and settle it outside, however the other party changed their mind and are now going through their insurance. My insurer informed me it will end up being 50/50 as previously discussed. I have no witnesses or cctv evidence to dispute this.

The reason why I didn't want to claim before was that I would lose my NCB, but now that they are claiming, I will lose it anyway, so is it worth me claiming for my damage? or will it increase my insurance premium more if I choose to claim?
any advice will be appreciated, thanks.
