    Joint enterprise is a 300 year old law which states that anyone affiliated with a person or a group whilst they commit a crime are liable for the exact same punishment that is given to the perpetrator. Do you think that this law should exist? If you do then why do you think that the justice system of this country has not had it overturned yet?

    Absolutely not. If said person is stupid enough to rob a bank or what have you with his chum and said chum guns someone down throw the book at both of them.

    The joint enterprise cases are not always this straightforward however; there have been cases in which people have been pressured into the wrong crowd, a crime is committed by one of them and then the ones who have done nothing are also punished, some people feel that this is morally wrong and therefore it can create controversy depending on how people view the case.

    Unfortunately that goes for most crimes thus the law has to be based on avereges and ease of application.

    It essentially involves locking someone up for something they haven't themselves done which is fundamentally wrong IMO.
