I think legally they can request the refund back from you. If that happened to me I would have kept the money untouched for a while and see if I hear back from the old previous employer and if not just spend it.

How much is the overpayment? If it is a big amount, then they are likley to ask for it back.

Legally, its theft if I remember correctly.

Its not yours. You didn't earn it. Therefore it doesn't belong to you. If you keep it, you are doing so dishonestly.

Espeically if they have been nasty to you

Just spend the money then theres nothing they can do about it :smile:
Seeing as you are leaving, keep it :p: and see if they realise.

If they find out, act like you didn't have a clue.

My mate got paid twice in a month once, lucky cow! She kept schtum and they never sussed.

They will almost certainly spot it. If it's a tiny amount (ie. they got your hours slightly wrong or something) they might not, but if they've paid you double or far more than they should have done then someone will notice. You'll be asked to pay it back eventually so whatever you do don't go out and spend it all! It will look far more honest and reasonable of you to let them know straight away. If you're leaving then maybe that doesn't matter to you, but I would still strongly suggest you let them know as soon as possible.

they'll probably ask for it back when they realise. it happened to me once,and they deducted the money from my future pay at one go. best not to spend it for a month or so,and if they don't realise after that,then you're ok :smile:

as everyone's said, you may be asked for it back etc, which they're within their rights to do.

personally, wait till they ask, it's happened to me before, and the attitude of my manager was "nevermind, their mistake, make the most of it". Depends why you've been overpaid - if a manager just put you down for more hours by mistake, it probably won't be picked up, especially if you work for a big organisation!

Just to agree with everyone else here, since you didn't earn it, it isn't yours and they can ask for it back. It happened to me once when I left an employer - they messed up the procedure when I returned the money so in the end I got to keep it anyway, but point was they asked for it back and I was expected to repay it so don't go spending it if you couldn't afford to return it if they noticed it.

I was at a Law open day with my friend - and this came up. Apparently, if you spend the money without realising it, they can't ask for it back. :smile:

i think i may have been overpaid once, i got 1.4k when i worked half my normal time, but it ws a weird week as i was kinda moving jobs, but i still work there on sundays. this month has been teh best 1.6k this month is brlliant!

If you worked a few weeks in hand and your leaving this could be those weeks in hand back paid plus your wages?

I've been overpaid and I don't really know wether to say anything either way lol.. I'm leaving anyway this week because theyve all been so horrible.. so this seems like karma is on my side, either way after sunday when i've left is there anything they can do? lol x



I would be honest and tell them, it might come back to get you if they find out.

Its illegal to keep it so i suggest you tell them. If you dont, they'll find out in their end of year accounts audits and it'll come back biting you in the backside.
Did you have any holiday pay unpaid? Could it possibly have been that they automatically added it on to your paycheck because you were leaving?
ha ha my mum got overpaid at tescos by about £50 she said to them that it happened and the person in the office just goes "well its their fault, i wudnt say anything as its too much paper work"
I reckon it depends on how much u got overpaid by obviously if its like £100 id personally feel a bit iffy about keeping it but if u said ur leaving then they were nasty lol then go ahead. It also depends on how big the company is for example i cant see tescos missing £50
I wouldn't worry too much about it, i got overpaid once where i work by quite a bit, and even got told by someone at work to take the money and run! That must have been about 6 months ago and they haven't even realised so its not certain they will notice that they have overpaid you. Anyway the time i was overpaid makes up for the fact that they tend to underpay me every single month lol. :mad:

Thats what I was thinking, too. Were you owed any holiday? because that may have been paid to you, hence why you think you got overpaid.

Also consider: They may realise, not be too bothered to get it back, but then write a not so nice reference should you come to rely on one from them. It would make me not want to hire you if there was someone just as good or slightly worse who had a good reference.
I was overpaid and didn't know until i got a very nasty letter in the post demanding it back or they were going to take it further, they admitted it was their error but they still wanted it back, when i called to get an explanation to the amount etc.... the woman was so rude to me just a nasty piece of work.

can any explain holiday pay to me, coz i was happy to pay the money back thinking i'd get holiday pay this month and i didnt.
