    In regards to the question these most be covered:
    1. Identify the legal issue involved (hint – for this tutorial, the issue will be whether D can be liable for the particular offence based on an omission and/or whether D caused the particular result)
    2. State the Law/Rule in relation to the legal issue
    3. Apply the Law/Rule to your facts
    4. Conclude – is the requirement met?

    a. Dermot and Victor are room-mates at University. One night Dermot cooks dinner for Victor. Unknown to Dermot, Victor has a very serious allergy to nuts. He makes his signature dish, which includes a nut-based oil. When they start to eat, Victor suddenly develops difficulty breathing. He asks Dermot did he use nuts when cooking, telling him that he severely allergic and is going into anaphylactic shock. He tells Dermot that if he doesn’t get a shot of adrenaline from his “epi-pen” which is in his bedside table that he will die. Dermot leaves Victor alone in the room and does nothing to help him. Victor dies.
