    Theresa is an MP. She needs a new car to ferry around her children, visit her constituents, and attend a small number of public engagements when she is not in Westminster.

    She bought a car online from CAR CAPITAL, a retailer specialising in second hand cars. She decided on the specific model that she purchased because the advertisement for the car explained that it was in “very good shape & with all latest tech gadgets”, despite being over 3 years old. The car cost her £15000. Once her order was placed, she received an email explaining that she has a right to cancel either within 14 days from the day she took possession of the car or before it has travelled 500 miles. She received the car promptly but it developed problems after just three weeks of driving it. During this time, she had driven approximately 650 miles. Theresa called CAR CAPITAL to ask them to remedy the problems that she was encountering with the car. She complained that the car has a scratch she had not noticed when she first received it; the wheels seem to shake unusually at high speed and the car satellite navigation system was also not working properly. It is linked to an app she has on her phone which keeps rerouting and never seems to work.

    The retailer agreed to carry out some repairs via a third party. The work done (which took nearly 6 weeks) did help somewhat and the car is driving well on the motorway. The scratch has disappeared and the body work looks as good as new. However, she is not able to find her way when using the satellite navigation system.

    Theresa wrote to CAR CAPITAL a few weeks back, to say that she thought
    ‘she should be allowed to “withdraw” from the contract. The Sat nav is after all essential to her work and without it she may as well be using public transport!’
    This letter, although received by the online retailer, remains without a response and Theresa decided to come to see you to assess her chances of getting rid of this car and getting her money back. Please advise Theresa of her rights under current legislation.
