I don't think employers are allowed to give bad references.

However, the can refuse to give a reference which is basically the same thing.

I always thought they could give bad references- as long as they are telling the truth obviously.
I could be wrong though.

But yeah, then can quite easily refuse to give references if they want to, which obviously doesnt look good.

If someone chooses to give a reference they have a legal obligation to tell the truth, and as the point of a reference is to give a professional opinion as to an individual's ability to do a job. It would not be honest to give a good reference if they were a bad employee. Employers can give bad references.

(I even signed a termination agreement stating I will not speak ill about my previous employers. But I did the right thing anyway.)

Fairly standard term for a termination or settlement agreement is to not talk about the reasons of the termination and therefore for that not to be present in references.
