I am doing a moot for my Tort law class and I need to argue why the doctor owed a duty of care to the claimants after the claimant became pregnant due to a failed sterilization. To do so I need to argue he did have a duty of care and it was just fair and reasonable to assume he had a duty of care. Can anyone give me a sterilization or even just medical UK case that shows doctors do have a duty of care to their patients?
