    In my opinion, neither. The whole concept is so wrong that it should be grounds for Sectioning under the Mental Health Act, as opposed to a crime.

    If it was rape, then that is clearly a crime
    If one is underage then that is clearly a crims

    As it is though, I would lean more towards classifying them both as being mentally ill.

    It doesn't look to me as thought they were mentally ill. It doesn't say that the mother had a long-term infatuation with her son and just waited for the occasion or anything like that...
