hello, please can anyone help me with this tort law problem question?
Jonny,a well-paid rugby union player, was injured when he stepped into the road without looking. David is driving his lorry down the same road, and is unwrapping a chocolate bar as he approaches the spot where Jonny is crossing. Consequently,he does not see Jonny until it is too late. Swerving, he almost manages to avoid Jonny, catching him a glancing blow before careering off into a paint factory owned by Sally.David's lorry if full of chemicals which when mixed with the paint, caused an explosion that damages the factory and its contents extensively.
Although Jonny was not badly hurt by the lorry, the impact has caused an old neck injury to flare up and he is in severe pain.He goes straight to see the team physiotherapist, Betty, who assures him that he does not need to go to hospital because she can deal with the injury. A week later, still in severe pain, Jonny goes to a hospital where, on examination, they inform him that his shoulder is badly damaged that he will never play rugby again. They also inform him that, had he come for treatment sooner, and not continued with physiotherapy, they might have been able to save it.
Advise the parties.
