EU Law: Directives Direct Effect - poor implementation?

Hi all,

I am hoping to clarify this issue. One of the conditions where a Directive may have direct effect is when the deadline for implementation has passed (Ratti).

My question is whether this also covers Directives which have been implemented but altered when brought into national law? For example the Directive provides for a grant to be given to all student who choose to study a science degree. In implementing the Directive the legislator excludes one group, those who choose to study physics, from the grant.

Is this poor implementation and incomplete?

Yeah it also applies to directive that have been introduced into national law but defectively: Verbond van Netherlandse Ondernemingen. So here implementing the grant for all science students but excluding physics will be defective implementation
