Annie and Bill are employed by Powerplus plc, a company providing maintenance for gas installations. Annie and Bill were called out to a gas leak in a house owned by Barbara, who is 76 years old and suffers from memory loss. Annie and Bill found that an old gas pipe leading to the gas fire in the living room needed replacing. While Bill was getting something out of the van Annie turned off the gas supply (or so she thought) and started to cut through the gas pipe in order to replace it, but the cutting machine created a spark and there was an explosion. Bill heard the noise and ran into the house to find a scene of devastation. Annie was groaning. Her face was black and her clothes were on fire. Bill extinguished the fire on Annie’s body, held her in his arms and gave her words of comfort and support. Barbara, who was in the garden at the time, suffered only minor cuts from broken window glass. When she went into the house she was horrified when she saw Annie and the state of the house. She phoned the emergency services and helped comfort Annie.
PC Keane arrived first at the scene. He helped Bill and Barbara comfort Annie, but Annie died in Bill’s arms.

Bill tried to contact Annie’s father Edward to tell him the terrible news, but was unable to reach him on his telephone. Eventually Edward received a voicemail on his phone but the sound quality was so poor all he could understand were the words “accident”, “Annie” and “hospital”. Edward immediately rushed to the hospital where, after an hour on trying to find his daughter, he was instructed to go to the mortuary to identify Annie’s body.
A subsequent fire investigation revealed that the cause of the explosion was because of a faulty gas valve, which had been supplied and fitted by Powerplus plc the previous year.

Bill and PC Keane, and have both suffered symptoms of psychiatric illness after the accident, including anxiety attacks, depression and nightmares. In Bill’s case the extent of his psychiatric injuries are made worse due to the fact that he had only just returned to work following a lengthy period off sick due to depression. Edward has suffered overwhelming grief.


Advise Bill, PC Keane and Edward, who all seek damages in negligence for psychiatric illness.
