Does anyone know how you can apply the control test, economic test, integration test and the multiple factor test into a problem question?

Sounds like a silly question but all of these tests have been criticised, so i'm not sure how I should use them in a problem question that asks you to assess the employment status.

If you are going to ascertain employee status you need to use the multifactorial test. You need to look at:



  • - Control
  • - Mutuality of Obligation
  • - Personal Service
  • - Whether other terms of the contract suggest employment status (e.g. uniform, tax, NI)




Within these there are different problems of application. If your problem question asks you to assess employee status then I would start with Autoclenz v Belcher. Supreme Court case.
