Hi John,

Unfortunately, this is an individual interpretation, this is not a government website or SFE. Moreover the routes are not detailed.

Alternatively, can you refer me to a court judgement on this issue.

[QUOTE=MFDickson;75789930]Hi John,

Student Finance England never accept in Beaurish Tigere’s case until it issued was resolved in High Court. I think this is another case that would get to High Court.

I have found the name of the Solicitor, his name is Paul Heron. He should be able to help me with my issue

Hi John,

Pls kindly see below; while I get back to you on the latest one you sent to me:

Nationality or residency status

Students can apply if:
* they're a UK national or have 'settled status' (that means there's
no restrictions on how long they can stay in the UK)
* they normally live in England
* they've been living in the UK for at least 3 years before the first
day of the first academic year of their course

The first day of the first academic year of their course is:
* 1 September, if their course starts between 1 August and 31
December
* 1 January, if their course starts between 1 January and 31 March
* 1 April, if their course starts between 1 April and 30 June
* 1 July, if their course starts between 1 July and 31 July

Students may also be eligible if they are one of the following:
* an EU national, or a relative of one
* a refugee, or a relative of one
* under humanitarian protection, or a relative of someone under
humanitarian protection
* under 18 and have lived in the UK for at least 7 years
* 18 or over and have lived in the UK for at least 20 years (or at
least half of their life)
* an EEA or Swiss migrant worker, or a relative of one
* a child of a Swiss national
* a child of a Turkish worker

n/full-time-tuition-fee-loan/eligibility/

Here EEA Migrant workers are separated from EU National. I’m beyond convince that a family member of UK National are included as well.

Dear Gerard,

Truly there are factual information on your eligibility criteria, these information are clearly stated and correct; there is no argument on this, unfortunately, the interpretation you are giving these criteria are completely wrong. Pls how do you interpret information below:

“Nationality or residency status

Bullet point 1, last paragraph states: EU National, or relative of one
Bullet point 6, also states: an EEA or Swiss worker or a relative of one.

Please what is your view on this as a manager.

Now my University (South Bank University) is asking me to pay £9250.00... where do I get this from; in order to minimise my liability, I’ve now withdrawn from my life-time ambition to become a Social Worker, facing bull to pay.

Furthermore, I have appealed your decision for fews days now but I was told appeal’s decision would take 20 days...

Please I will be expecting your view on this issue.

Hi,

I'm sorry for the wait for a response.

I appreciate that the decision is not clear cut and as I am unable to see you the students full account history, I would be unable to comment.

I would recommend either waiting for a response to the appeal, alternatively we would be happy to discuss by telephone?

Regards,

Gerard
