Write a total number of no more than 1200 words (approximately 500 – 600 words for each scenario) on whether any offences have been committed under the Official Secrets Act 1989 in the following two scenarios. An analytical discussion of the Act supported by relevant authorities (where necessary) is required. No credit shall be given for substantial verbatim extracts from the Act.
scenario 1 :
Terry works as a senior civil servant at the Ministry of Defence. One day, whilst reviewing certain files on the Ministry’s database, he sees an order from the British Army for four combat jets. The file indicates that the jets are armed with particular weapons that make them very effective for ground strikes. The file that contains the order also indicates that British pilots will use these jets in a particular part of Afghanistan. Terry downloads the file and forwards to his personal email address as an attachment. His girlfriend Cindy has access to his personal email account and opens the file later that day out of sheer curiosity.
