My Essay question for legal theory:
To say that these constitutional review bodies [courts with the power of constitutional review] “interpret” the constitution is largely empty. It is easier to think in terms of their trying to answer questions posed to them by others by looking at these documents. … The judges are required to weave the bullet points into a coherent and cohesive ideology for their contemporary world. It is in this sense that constitutional judges are applied political theorists, and their job is unavoidably creative.” (David Robertson) Discuss.
How would you guys interpret this question?
I understand it in this way: Do Supreme Court judges develop social values?
