What does 'prior diversity of occupation' mean in the context of Easements? Specifically with the Wheeldon v Burrows Rule and Section 62?
Thanks

It means where the 2 pieces of land were occupied by different people at the relevant time. This would not be satisfied, for example, where a landowner uses a shortcut over a field next to his house when he owns and occupies both the field and the house (a quasi- easement' situation).
