Breaking agreement - money back?

Hey,

So I am going to brake my tenancy agreement and I have already found a replacement... My question is now: Will I get the three monthly rents I have paid in advance+deposit back ? ( I am a European student and that’s why they wanted me to pay 3 rents in advance)

It depends what your contract says. Has it started? have you checked they wont charge an admin fee? It should say what happens to your deposit and a refund. Depending who they are then they can sometimes take a long time . Read your contract.

It is not mentioned in my contract... The contract has started and I will have to pay a fine, but I knew that before...

I cant see the contract.
You can talk to Shelter.

Depends who your LL is and how professional. Lot of LL and letting agents are jerks and will seek to charge for anything.

Contact Shelter or CAB. Tbh id expect to pay up until the day the other person takes over.

It is actually a professional company( Spaces Urban Living). I mean there is no reason why they should keep my money...

You will have to wait and see. They may try and take large amounts of it though. Only they can tell you. See how it goes and ask them to get an idea what they intend to do. You should also look in the agency terms and conditions.

If you have assigned the contract to this third party, then this third party might well have the benefit of the advance rents. It would then be on you to get this person to agree to pay you for the advance payments as part of your assignment.

If you're merely cancelling the contract and someone else is taking over, then presumably you would only be liable for the fine.

If the advance rents are stated to be non-recoverable in your tenancy agreement, this is not final. Unreasonable terms in tenancy agreements are potentially voidable.

Depends on the contract and mentality of the letting agent. Contact them and find out. Seek help from CAB, Shelter or other housing specialist if you face any difficulties.

Thank you very much! I was just worried because I cannot contact them on weekends and wanted some advice just to be sure..
