The Student Room Group

Theft act

can anyone help with the following using the IRAC method please?

Stuart was in his university study area and fancied a bar of chocolate from the vending machine. Stuart inserted the correct amount of money into the vending machine for one chocolate bar, by mistake the vending machine dispensed two. Stuart realised the mistake, however he subsequently started to eat them both as he left the study centre.

Discuss Stuart`s criminal liability with regards to taking the extra bar of chocolate from the vending machine.

Claim - which part of the Theft Act are you looking at?
Law - what does the statute say?
Evaluate - Does S's conduct fit the AR and MR of the statute, and are there any valid defences?
Outcome - Decide what you want to argue. Liken S's conduct to similar cases that agree with your assessment, and differentiate them from cases that don't.
