Hi guys,
Just a problem regarding interim prohibitory injunctions vs freezing injunctions. In a problem such as this, which would be better advised:
A (claimant) and B (defendant) enter into a debt agreement whereby B enforces A's debts from customers and pays them to A, keeping 10% as payment for services. However, B keeps the majority of the debts and, upon finding out, A informs customers so make payments to A only. B is now moving abroad out of the jurisdiction with a large sum of money in possession.
Would it be an interim prohibitory injunction to stop B taking more money/moving or a freezing injunction to stop the assets (money) being sent off?
